Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and the publisher of GeMax TD (the "Game", "we", "us", "our"). By downloading, installing, or using the Game or the Site at td.gemax.online, you agree to these Terms. If you do not agree, do not use the Game or the Site.

1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Game. If you are a minor, you must have permission from a parent or legal guardian, who agrees to these Terms on your behalf.
2. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Game on devices you own or control, solely for personal, non-commercial entertainment. All rights not expressly granted are reserved.
3. Your account & save data
The Game runs locally and stores progress on your device. You are responsible for backing up your device. We are not liable for save data lost due to device failure, OS-level wipes, uninstall, or loss of access to your platform account. If we add a cloud-save feature, additional terms may apply and will be presented at sign-up.
4. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law
- Modify, hack, or use unauthorized third-party software to gain unfair advantages
- Use the Game to violate any law or third-party rights
- Resell, rent, lease, or commercialize access to the Game
- Circumvent ad delivery, purchase verification, or rate limits
- Use automated means (bots, scrapers) to interact with the Game or Site
We may suspend or terminate access for violations.
5. In-app purchases
The Game may offer optional one-time in-app purchases. The specific items available, their prices, and any limited-time offers are presented in-app at the point of purchase and may change from time to time. All transactions are processed through the platform store (Apple App Store or Google Play). When you confirm a purchase, you authorize the platform to charge your selected payment method. Prices are displayed in your local currency where supported and may include taxes. Promotional pricing is time-limited and at our discretion.
6. Subscriptions
The Game may offer one or more optional auto-renewing subscriptions. Specific subscription names, durations, prices, and benefits are presented in-app at the point of purchase and may change over time. The terms below apply to any subscription offered through the Game:
- Billing. Subscriptions are billed in advance for the chosen period (e.g., weekly, monthly, yearly).
- Auto-renewal. Subscriptions automatically renew at the same price (subject to applicable price-change terms in your platform store) unless cancelled at least 24 hours before the end of the current period.
- Cancellation. Manage and cancel from your platform account: iOS — Settings → Apple ID → Subscriptions. Android — Play Store → Profile → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current paid period; you continue to enjoy benefits until then.
- Free trial. If a free trial is offered, it converts to a paid subscription unless cancelled before the trial ends. You can use a free trial for a given subscription only once per platform account.
- Price changes. If we change the price, we will notify you and give you the opportunity to cancel before the new price applies.
- Benefits. Specific benefits are described in-app at the point of purchase. Benefits may evolve over time; we will not materially reduce them without notice.
- Termination. If your subscription is terminated for cause (e.g., violation of these Terms), no refunds are owed for the unused portion.
7. Refunds
Refund requests for in-app purchases and subscriptions are handled by the platform store under the store's policies. We do not directly process refunds for store transactions:
- Apple App Store. Visit reportaproblem.apple.com.
- Google Play. Visit play.google.com/store/account → Order history → "Report a problem".
Where local consumer law (including the EU right of withdrawal) requires us to provide a refund directly, contact support@gemax.online with your transaction ID and we will assist.
8. Virtual items & currency
Any in-game items, currencies, or progression goods (whether earned through play or purchased) are virtual goods licensed to you for use within the Game. They have no real-world value, cannot be redeemed for cash, and cannot be transferred outside the Game. We may modify, suspend, or remove virtual items as needed for game balance, security, or legal reasons. Unused virtual items are forfeited if your access to the Game is terminated for cause or if the Game is permanently shut down (subject to applicable law).
9. Updates & availability
We may release updates, hotfixes, or content changes that adjust gameplay, balance, or features. Some updates may require you to update the Game to continue using it. We may discontinue features or the Game itself, with reasonable notice where practical.
10. Third-party services
The Game integrates third-party services (e.g., advertising SDKs, analytics, app-store frameworks, font providers). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services' actions.
11. Intellectual property
The Game and Site, including their code, art, audio, characters, design, trademarks, and logos, are owned by us or our licensors and are protected by intellectual-property laws. The "GeMax TD" name and logo are our trademarks. You may not use them without our prior written permission, except for fair use such as accurate referral to the Game.
If you submit feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
12. Disclaimers
The Game and Site are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or secure. Some jurisdictions do not allow disclaimers of implied warranties; in those, the disclaimers above may not apply to you to the extent prohibited by law.
13. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or in connection with the Game or these Terms. Our total liability for any claim arising out of these Terms or the Game will not exceed the greater of (a) the amount you paid us for the Game in the 12 months preceding the claim, or (b) USD 50.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., for gross negligence, willful misconduct, or statutory consumer rights).
14. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of law, or your misuse of the Game.
15. Termination
We may suspend or terminate your access to the Game at any time, with or without notice, for any reason, including a violation of these Terms. You may stop using the Game at any time by uninstalling it. Sections that by their nature should survive (IP, disclaimers, liability, governing law) survive termination.
16. Governing law & disputes
These Terms are governed by the laws of Brazil, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of São Paulo, Brazil, except where applicable consumer law gives you the right to bring a claim in your country of residence. Where local law requires, you retain all mandatory consumer protections regardless of this section.
17. Changes
We may modify these Terms. The updated "Last updated" date reflects the change. Material changes will be communicated through the Game or Site. Continued use after the change takes effect constitutes acceptance.
